If cancelling 999 days before arrival, forfeit 75% of the deposit total.

We reserve the right to not refund card fees (transaction costs) in the case of any cancellation or situation where funds need to be reversed back to a credit card

1. BOOKING

The booking is confirmed upon receipt of a 50% deposit of the total accommodation cost. The deposit is payable within 48 hours after the booking is made, failing which the accommodation may be let to a third party.

The reservation/booking dates will be held for a maximum of 48 hours ahead of receiving the payment.

The balance of the total accommodation, including a refundable breakage charge of R5,000.00, shall be payable 14 days before arrival.

Short notice bookings (within 14 days of the booking dates) require the total accommodation amount, including the refundable breakage deposit of R5,000.00, to be paid within 24 hours, payable immediately.

All rates and amounts are in South African Rand.

Electronic Funds Transfer (EFT) or a direct bank deposit is acceptable to the bank account detailed on the invoice.

Receipt of the payment binds the guest, Owner, and Management to this rental agreement.

Should you wish to cancel your booking for a valid unforeseen reason after payment has been made, we will make every reasonable effort to re-let the accommodation for the period booked. If successful, we will refund your payment less than 25% handling fee; however, if we are unable to re-let the accommodation, the cancellation condition policy shall apply as set out herein.

2. PHOTO/STILLS AND FILM SHOOTS

Different rates apply to events, photo/stills and film shoots – on request only.

3. CANCELLATION POLICY

15 days or more before arrival: The guest forfeits 75% of the deposit payment.

0 to 14 days before arrival: The guest forfeits 100% of the total accommodation payment.

4. ARRIVAL AND DEPARTURE

The accommodation is available from 14h00 (2:00 PM) on the day of arrival. Guests must confirm their estimated time of arrival.

On arrival, guests are to sign in at the security gate/boom.

Should you wish to arrive later than 17h00 (5:00 PM), prior arrangements must be made; failing which entry on that day may be denied.

Silver Bay Villa Management will meet you on the premises for a short tour and key handover.

Once keys are handed over, guests may come and go as they please.

A selection of local attractions/services is detailed in the guest instruction manual.

The accommodation must be vacated by 10h00 (10:00 AM) on the day of departure.

A late check-out is subject to availability and can only be confirmed on-site on the day of departure. To guarantee a late check-out, you must book an additional night.

Guests shall be held liable for any incidents, losses, thefts, or damages if the keys are not strictly handed over to Management or the host on departure.

On departure, ensure the premises and all doors are properly locked up and the burglar alarm is activated. Arrange with Management to hand over the key and the remote.

5. OCCUPANCY

The number of persons occupying the premises must not exceed the maximum number stated in the description or on the invoice.

If the number of people exceeds the stated maximum, you will be charged additional fees (as determined reasonably by the house manager), or excess guests will be asked to leave.

Only guests whose names appear on the invoice are permitted.

Any unauthorized persons not originally booked will be charged at a rate of R2,000.00 per person, which you undertake to pay.

All guests must act and behave reasonably and have consideration for the neighbors.

The Owners reserve the right to terminate the let if guests cause a disturbance or nuisance.

Music and noise levels must be kept down to an acceptable level for all residents in the area/development.

6. PROPERTY SAFETY & SECURITY

Unauthorized persons/visitors are not allowed.

Please lock all doors during the day and at night.

Ensure that the garage door is always closed and locked.

The security alarm is to be activated whenever the premises are left unoccupied.

Guests are to adopt vigilance and due care and will be briefed on security measures upon arrival.

7. PETS & SMOKING

This is a Non-smoking premises. Smokers must use ashtrays and “bud buckets” outside.

No candles are permitted.

Unfortunately, no pets are allowed.

8.BREAKAGES

The guest undertakes to keep all furniture, furnishings, fixtures, and electrical items in the same state and condition as at the commencement of their stay.

Guests must leave the premises in the state of cleanliness as when they arrive.

Any tampering or interference with the TV/DStv settings, wiring, or amplifier rewiring will result in a call-out charge.

Books, magazines, and other items available to guests are not to be removed from the premises.

Kindly report any damages and breakages that may have occurred during your stay.

The Owners shall be compensated by the guest/applicant for any damages, breakages, and any excess cleaning required. Decisions in this regard are at the sole discretion of the Owners and Management, acting reasonably.

9. RISK OF LOSS AND INDEMNIFICATION

All personal property, effects, and items brought onto the premises by a guest or their visitors shall be at the sole risk of the guest and occupants from any theft, damage, or loss.

The Owners and Management do not accept liability for any loss or damage to person or personal property, however caused, and are fully indemnified by the guests.

10. UNAVAILABILITY OF PROPERTY: –

If Silver Bay Villa sustains physical damage during a rental term, causing it to be unsuitable or unsafe for occupancy, the Owners and Management shall not be held liable for any resulting inconvenience, loss, or expenses incurred by the guest.

The Owners will make reasonable efforts to assess damage and, if possible, either repair promptly or offer a replacement property (similar in capacity, location, and value), subject to availability.

If a suitable replacement cannot be located, any payments made for unused rental periods shall be refunded, and this agreement will terminate without further liability.

This clause addresses damage to the premises itself and is distinct from other provisions regarding events beyond the Owners’ reasonable control.

11. MUNICIPAL SERVICES

If municipal electricity or water services are disrupted, the guest shall immediately notify Management, and reasonable efforts will be made to restore services.

If the event is beyond the reasonable control of the Owners and Management, the guest shall hold the Owners and Management harmless against any claims.

12. ASSIGNMENT OF SUBLEASE

The guest shall not assign or sublease Silver Bay Villa or permit the use of any portion of the premises by any other person/s who is not a family member or a permitted occupant under this agreement.

The premises shall not be used for any purpose aside from a residential self-catering accommodation.

Special functions, events, photo/stills, and film shoots are not permitted without prior written approval of the Owner.

 13. INSURANCE DISCLOSURE

The guest acknowledges and agrees that it is their sole responsibility to obtain and maintain adequate personal insurance coverage (personal injury, medical aid, loss or damage to personal property, etc.) for the duration of their stay.

The guest confirms they are financially responsible for any costs or expenses that may arise due to incidents not covered by their insurance.

14. FORCE MAJEURE

The Owners shall not be held liable or deemed in breach of this agreement for any failure or delay due to events or circumstances beyond their reasonable control. Such events include, but are not limited to, natural disasters, pandemics, acts of government, and supply interruptions.

In a force majeure event, the Owners reserve the right to suspend or terminate this agreement without liability or obligation to refund any payments made by the guest, except as may be determined at the sole discretion of the Owner.

15. SEVERABILITY

If any provision is found to be invalid, illegal, or unenforceable, it shall be deemed severed, and the validity and enforceability of the remaining provisions shall not be affected.

16. ENTIRE AGREEMENT

This agreement constitutes the entire agreement and supersedes all prior agreements. No amendments shall be valid unless made in writing and signed by both parties.

17. NON-VARIATION

No variation, amendment, or modification shall be valid unless reduced to writing and signed by both the Owners or Management and the guest. Waiver of one provision does not constitute a waiver of any other.

By proceeding with the reservation, you further agree to and acknowledge the terms and conditions stated herein.
